Agreement to Terms
By accessing or using KivoClas ("KIVO", the "Platform"), operated by KivoClas, S.R.L. (RNC 1-33-67772-5, registered in the Dominican Republic), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform. These terms constitute a legally binding agreement between you and KivoClas, S.R.L.
Description of Service
KIVO is an AI-powered multilingual classifieds marketplace serving the Bavaro-Punta Cana area of the Dominican Republic. The platform allows users to post listings for goods and services, communicate via real-time translated chat, create professional profiles, and find local services. KIVO acts as a platform connecting buyers and sellers — we are not a party to any transaction between users.
Account & Authentication
You must provide a valid phone number to create an account. Authentication is performed via one-time passwords (OTP) sent to your phone. You are responsible for maintaining the security of your account and for all activities that occur under it. You must not share your authentication credentials or allow others to access your account. Each person may maintain only one account.
User Content
You retain ownership of the content you post on KIVO, including listing text, photos, and profile information. By posting content, you grant KIVO a non-exclusive, worldwide, royalty-free license to display, distribute, and process your content as necessary to operate the platform. This includes AI processing for translation, content generation, and photo analysis. You are solely responsible for the accuracy and legality of your content.
Profile Types
KIVO offers three profile types: Personal, Specialist, and Business. Specialist and Business profiles require email verification. Each profile type has specific listing limits and features. You may switch your profile type, subject to a 7-day exploration window for new accounts and a 30-day cooldown period between subsequent changes. Profile information must be truthful and accurately represent you or your business.
Prohibited Activities
- Posting false, misleading, or fraudulent listings
- Selling illegal goods or services, including drugs, weapons, counterfeit items, or stolen property
- Harassment, threats, hate speech, or discrimination against other users
- Spamming, posting duplicate listings, or manipulating search results
- Impersonating other individuals or businesses
- Attempting to circumvent platform security, rate limits, or moderation systems
- Using the platform for money laundering or any illegal financial activity
- Scraping, crawling, or automated data collection without permission
- Posting sexually explicit content or soliciting illegal services
- Interfering with the platform's infrastructure or other users' experience
AI-Generated Content
KIVO uses artificial intelligence (Google Gemini) to assist with listing creation, message translation, photo analysis, and content generation. AI-generated content is provided as a convenience and may contain errors or inaccuracies. You are responsible for reviewing and approving any AI-generated content before it is published. KIVO is not liable for errors in AI-generated translations or content.
Intellectual Property
The KIVO platform, including its design, code, logos, and AI systems, is the intellectual property of KivoClas. You may not copy, modify, distribute, or reverse-engineer any part of the platform. User-generated content remains the property of respective users, subject to the license granted in these terms.
Limitation of Liability
KIVO is provided "as is" without warranties of any kind. We are not responsible for transactions between users, the quality of goods or services listed, or any disputes arising from user interactions. KIVO shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to KIVO in the 12 months preceding the claim.
Content Moderation
KIVO employs post-moderation — content is reviewed after publication based on user reports and automated systems. We reserve the right to remove any content that violates these terms or our Community Guidelines without prior notice. Users can report listings, chat messages, and profiles through the built-in reporting system.
Subscriptions & Payments
KIVO offers free and premium (Plus) tiers. Plus subscriptions grant enhanced visibility and additional capacity for listing physical goods and offline services to local buyers in the Bavaro-Punta Cana area.
- Free period. During the current free period, all Plus features are available at no cost. Paid subscriptions will launch at a later date, with pricing and billing terms communicated in advance.
- Billing channel. When paid subscriptions launch, Plus subscriptions for physical business and service listings will be billed through our web checkout at kivoclas.com, not within the mobile app.
- Cancellation. You may cancel your subscription at any time through your account settings. Cancellation stops future renewals; you retain Plus features until the end of the current billing period.
- Refunds. Subscriptions are non-refundable once the billing period has started, except where required by applicable consumer protection law. We may, at our discretion, issue partial refunds for exceptional circumstances.
- Price changes. We reserve the right to modify pricing with at least 30 days' notice to existing subscribers. Continued use after the notice period constitutes acceptance of the new pricing.
- Auto-renewal. If auto-renewal is enabled, your subscription will renew automatically at the end of each billing period unless cancelled. You can disable auto-renewal at any time.
Account Termination
We may suspend or terminate your account if you violate these terms, engage in prohibited activities, or upon your request. You may delete your account at any time through the in-app account deletion feature (Profile → Settings → Delete Account) or by contacting us at admin@kivoclas.com. Upon termination, your listings will be removed and your personal data will be handled according to our Privacy Policy.
Dispute Resolution
Before initiating any legal proceedings, you agree to attempt to resolve disputes by contacting us at admin@kivoclas.com and allowing us a reasonable period (at least 30 days) to respond and seek an amicable resolution. This informal resolution step is mandatory before pursuing formal legal action, except where urgent relief is required.
Governing Law
These Terms of Service are governed by the laws of the Dominican Republic. Any disputes arising from these terms or your use of the platform shall be resolved in the courts of the Dominican Republic. By using KIVO, you consent to the jurisdiction of these courts.
Changes to These Terms
We may update these Terms of Service from time to time. Material changes will be communicated through the platform or via email. Continued use of KIVO after changes are posted constitutes acceptance of the updated terms. We encourage you to review these terms periodically.
